Terms of Use

These Terms of Use ("Terms") govern your use of the Talma app for iOS ("Talma", "the app"). By downloading or using the app you agree to these Terms. The app is operated by Alina Dauhaliova, a sole proprietor registered in Portugal ("we", "us"). You must be at least 13 years old (or the age of digital consent in your country) to use the app.

License and EULA

Use of the app is also subject to Apple's Licensed Application End User License Agreement (standard EULA). We grant you a personal, non-transferable, non-exclusive license to use Talma on Apple devices that you own or control, for your personal, non-commercial use. Apple is not responsible for the app or its content and is a third-party beneficiary of these Terms, with the right to enforce them.

Account

You can use Talma without an account. An account (Sign in with Apple) is needed to sync your drawings and progress across devices. You are responsible for keeping access to your Apple Account secure. You can delete your account at any time in the app's settings; this deletes your synced data as described in our Privacy Policy.

Subscriptions

• Some content and features require a paid subscription. Prices are shown in the app before purchase.
• Payment is charged to your Apple Account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in your Apple Account settings (Settings → Apple Account → Subscriptions).
• If a subscription includes a free trial, any unused portion of the trial is forfeited when you purchase a subscription.
• Refunds are handled by Apple under Apple's refund policy; we cannot issue refunds directly.

Your content

Drawings you create in Talma are yours. You can save, export, and share them freely. So that the app can work, you grant us a limited, worldwide, royalty-free license — sublicensable to the service providers that run Talma on our behalf — to store and process your drawings solely to operate and provide the features you use: for example to render them, sync them to your devices, and generate the animations and share clips you request. You confirm that you have the necessary rights to any content you create or share through the app, and you are responsible for anything you choose to share. Lesson artwork, templates, and other app content remain our property (or that of our licensors) and may not be resold or redistributed outside the app.

If you send us feedback, suggestions, or ideas about the app, we may use them freely to improve Talma, without any obligation or compensation to you.

Acceptable use

You agree not to reverse engineer the app, interfere with its operation or its services, or use it in any unlawful way. If your breach of these Terms or violation of someone else's rights causes claims or losses to us, you agree to compensate us for the resulting damages and reasonable costs, to the extent permitted by the law of your country of residence.

Disclaimer

Talma is a drawing-learning app provided "as is". We do our best to keep it reliable, but we do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, we are not liable for indirect or consequential damages arising from your use of the app, and our total aggregate liability for any claims relating to the app is limited to the amount you paid us for the app in the 12 months before the claim arose. Nothing in these Terms limits rights you have under mandatory consumer protection law, or excludes liability that cannot be excluded by law. To the extent permitted by that law, any claim relating to the app must be brought within one year of the events giving rise to it.

Changes to the app

We keep improving Talma: lessons, features, and content may change, be added, or be removed over time. We may discontinue a feature or the app itself; if we do while you have an active subscription, you keep access for the period you have paid for, or you may seek a refund for the unused portion under Apple's refund policy.

Termination

You can stop using the app and delete your account at any time in the app's settings. We may suspend or terminate access in case of a material breach of these Terms; in that case, amounts already paid are not refunded by us (Apple's refund policy still applies).

Changes

We may update these Terms from time to time. If we make material changes, we will update this page, change the date above, and give you notice in the app. If you do not agree with the updated Terms, you may stop using the app and cancel your subscription; continued use after the change takes effect means the updated Terms apply.

Governing law

These Terms are governed by the laws of Portugal. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live.

General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions stay in full force. We may assign these Terms as part of a sale or reorganisation of our business; you may not assign them without our consent.
